Terms of Service
Introduction
These Terms of Service ("Terms") govern your use of ShiftER, a hospital scheduling platform operated by Doha Dynamics ("we," "us," or "our"). By accessing or using ShiftER, you agree to be bound by these Terms. These Terms are effective as of June 2025.
Use of Service
ShiftER is a B2B SaaS scheduling platform designed for healthcare institutions. You represent that you are an authorized representative of your organization with authority to bind your organization to these Terms. The service is intended solely for healthcare workforce scheduling and may not be used for other purposes without our written consent.
Account Responsibilities
You are responsible for:
- Providing accurate and complete information during registration
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
Intellectual Property
All intellectual property rights in ShiftER, including software, algorithms, documentation, and branding, are owned by Doha Dynamics. You are granted a limited, non-exclusive, non-transferable license to use the service. Your organization retains ownership of all scheduling data and staff information entered into the platform.
Data Processing
Our data processing practices are governed by our Privacy Policy and Data Processing Agreement, which comply with Qatar's Personal Data Protection Law (PDPL) and GDPR requirements. All data is processed and stored in Qatar-hosted infrastructure.
Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble the software
- Attempt unauthorized access to our systems or networks
- Use the service for any purpose outside healthcare workforce scheduling without written consent
- Violate any applicable laws or regulations
- Interfere with or disrupt the integrity or performance of the service
Service Availability
We target 99.9% uptime for the ShiftER platform. Planned maintenance will be communicated at least 48 hours in advance. We are not liable for downtime caused by factors beyond our reasonable control, including force majeure events, network failures, or third-party service disruptions.
Limitation of Liability
To the maximum extent permitted by law, Doha Dynamics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of ShiftER. Our maximum liability is limited to the fees you paid in the preceding three months.
Termination
Either party may terminate the service agreement with 30 days written notice. Upon termination, you will have 14 days to export your data from the platform. We reserve the right to immediately suspend access if we reasonably believe you have violated these Terms.
Governing Law
These Terms are governed by the laws of the State of Qatar. Any disputes arising from these Terms or your use of ShiftER shall be resolved in the courts of Doha, Qatar.
Changes to Terms
We may modify these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the service after changes become effective constitutes acceptance of the modified Terms.
